This Mail Service Agreement (“Agreement”) is entered into by and between Nomad Mail Co., doing business as Escapees Mail Service (“Escapees Mail Service”), and the undersigned subscriber (“Subscriber”). By purchasing or using Escapees Mail Service, Subscriber agrees to the following terms:
- Non-Refundable Fees: All fees, with the exception of those expressly identified as refundable, are non-refundable.
- Subscription and Activation: New Mail Service accounts shall be charged the applicable subscription fee at the time of purchase. Service shall begin only after all required documentation is submitted and approved, and a mailing address is established.
- Required Documentation: Subscriber agrees to complete and submit all necessary forms—including U.S. Postal Service Form 1583 and any required service of process acknowledgment—within sixty (60) days of purchase. Failure to complete setup within this timeframe will result in account termination and issuance of a refund minus a non-refundable administrative fee of fifty dollars ($50). Subscriber further agrees to submit a notarized and updated PS Form 1583 upon request if any submitted information changes or expires.
- Individual Authorization Requirements: Each individual or entity listed on the account must complete a separate PS Form 1583, including photocopies of acceptable forms of identification, to be authorized to receive mail at Escapees Mail Service.
- Automatic Renewal: Upon the conclusion of the initial subscription term, and each renewal term thereafter, the subscription shall automatically renew on the first (1st) day of the new term. Billing shall be processed preceding expiration. Renewal will be for the same term length and billed at the then-current rate unless canceled prior to the renewal billing date. Renewal preferences and billing details are available through the Subscriber’s online account.
- Postage Account and Auto-Recharge: Subscriber agrees to maintain a minimum postage account balance of twenty-five dollars ($25). To ensure uninterrupted service, Subscriber authorizes Escapees Mail Service to automatically charge the payment method on file for one or more increments of the auto-recharge amount designated in the Subscriber’s account settings (default: $25), as needed to maintain the minimum balance.
- Confidentiality and Legal Compliance: Subscriber’s PS Form 1583 and assigned mailing address shall remain confidential except when disclosure is legally mandated or requested by law enforcement or other authorized government agencies.
- Joint Account Ownership: Accounts with multiple subscribers shall be held as joint tenants with rights of survivorship.
- Undeliverable Mail: Mail received without a proper address may be returned to sender marked “Undeliverable as Addressed” or “Insufficient Address.”
- Prohibited Uses: Subscribers shall not use Escapees Mail Service for any purpose that violates federal, state, or local law, including but not limited to receiving perishables, refrigerated items, hazardous materials, liquids, alcohol, firearms, ammunition, tobacco products, or illegal substances. Prohibited items will not be accepted.
- Oversized or Unwieldy Shipments: Escapees Mail Service reserves the right to reject or request the removal of oversized, heavy, or unwieldy packages. Subscriber shall remove such items within thirty (30) days of notice or incur a storage fee, as determined by Escapees Mail Service.
Termination of Service: Upon expiration, cancellation, or termination of this Agreement, Escapees Mail Service shall:
- Forward first-class mail for up to six (6) months, provided Subscriber has prepaid postage and supplied a forwarding address (USPS Change of Address forms will not be accepted). Escapees Mail Service will issue refunds via check for any unused postage.
- Discard or destroy unsolicited bulk mail such as catalogs or advertisements.
- Hold mail for up to six (6) months if no forwarding address is provided, after which it will be returned to sender.
- Abandoned Property: Any packages remaining at Escapees Mail Service six (6) months after termination—or thirty (30) days after written notice to remove such items—shall be deemed abandoned. Escapees Mail Service may dispose of such items at its sole discretion, without obligation or liability to Subscriber. Subscriber waives any claims arising from such disposition.
- Acknowledgement of Terms: By using the service, Subscriber agrees to the Terms of Service and Privacy Policy, available at Escapees Mail Service website, and acknowledges responsibility for reviewing them regularly for updates.
THESE TERMS AND CONDITIONS ARE CHANGEABLE AT ANY TIME AT THE SOLE DISCRETION OF ESCAPEES MAIL SERVICE.
Disclaimer and Waiver of Damages: Escapees Mail Service shall have no liability for damages, direct, indirect, consequential or otherwise to any person, authorized agent, organization, or institution as a result of the use of this service, and Subscriber waives and releases all such claims for damages. Notwithstanding such, Subscriber agrees that Escapees Mail Service’s maximum liability, if any shall not exceed $25, irrespective of any claim or category, including attorney’s fees.
THIS AGREEMENT IS GOVERNED BY TEXAS LAW AND EXCLUSIVE JURISDICTION AND VENUE RELATING IN ANY WAY TO THIS AGREEMENT, INCLUDING DISPUTES, SHALL LIE SOLELY IN SAN ANTONIO, BEXAR COUNTY, TEXAS.
